A University Student Sues Equity Bank For Using His Song With No Pay

Eric Obiero Nyadida a university student has gone to court over a Sh10 million pledge.

He claims composition of the popular song used by Equity Bank to promote its business. This is pending other constitutional and fundamental relief.

Erick Obiero asked the High Court to ban Equity bank from using the song to advertise its Wings to Fly education project.

Appearing before before Justice Wilfrida Okwany, said his rights were violated when he was locked up in a police cell at Kileleshwa Police Station with adults when he was 16 till October 2017 where he was released due to lack of evidence.

Obiero says he was also denied his lawful rights and access to his parents while in imprisonment.

Obiero, who currently is pursuing a Journalism course, told Justice Okwany that over the last six years he has suffered mentally and his intellectual property rights violated.

He said he was drawn through a criminal trial because he asked the bank to pay him Sh10 million as promised by senior officials of Equity Bank (Kenya) Limited and Equity Group Foundation (EGF) for using his song.

The petitioner says the lender has continued to use his work with no direct benefit going to him and should be forbidden from using it by the court.
